§ 2 Scope
(1) These Terms and Conditions apply to all orders placed via the online shop www.josianebiwer.com as well as via our social media channels.
(2) Our offers are directed exclusively at consumers within the meaning of applicable European consumer protection laws.
(3) Luxembourg law shall apply, taking into account mandatory consumer protection provisions of European Union law, in particular the General Data Protection Regulation and the Consumer Rights Directive.
§ 3 Conclusion of Contract
(1) The presentation of products in the online shop does not constitute a legally binding offer.
(2) By completing the order process, you submit a binding offer.
(3) A contract is only concluded upon our explicit confirmation by email.
(4) The contract text is stored and can be provided upon request.
§ 4 Prices and Shipping Costs
(1) All prices are stated in Euro and include applicable VAT.
(2) Shipping costs:
- Luxembourg: €8.10
- Europe: €16.10
(3) For deliveries outside the European Union, additional customs duties or taxes may apply and must be borne by the customer.
§ 5 Payment Terms
(1) Payment is processed via PayPal.
(2) Payment is initiated immediately upon completion of the order.
(3) The terms and conditions of PayPal apply.
§ 6 Delivery
(1) Delivery is made to the address provided by the customer within Luxembourg and Europe.
(2) Delivery time is approximately 1–2 weeks unless otherwise stated.
(3) If a product is unavailable, you will be informed without delay.
§ 7 Retention of Title
The goods remain our property until full payment has been received.
§ 8 Right of Withdrawal
Withdrawal Policy
You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period is 14 days from the day on which you, or a third party designated by you, take possession of the goods.
To exercise your right of withdrawal, you must inform us

by means of a clear statement.
To meet the withdrawal deadline, it is sufficient that you send your communication before the withdrawal period has expired.
Consequences of Withdrawal
If you withdraw from this contract, we shall reimburse all payments received from you, including delivery costs, without undue delay and no later than 14 days.
Reimbursement will be made using the same payment method used for the original transaction.
We may withhold reimbursement until we have received the goods back or you have provided proof of return.
You shall bear the direct cost of returning the goods.
Exclusion of Withdrawal
The right of withdrawal does not apply to:
- custom-made products
- personalized goods
§ 9 Returns
(1) Goods may be inspected as in a physical retail store.
(2) In case of excessive use, compensation for loss of value may be required.
§ 10 Warranty
(1) A statutory warranty period of 2 years applies in accordance with European law.
(2) In case of defects, you are entitled to repair or replacement.
§ 11 Liability
(1) We are fully liable in cases of intent and gross negligence.
(2) In cases of slight negligence, we are only liable for breaches of essential contractual obligations.
(3) Liability is limited to foreseeable damages.
§ 12 Dispute Resolution
The European Commission provides a platform for online dispute resolution:

We are not obliged to participate in dispute resolution proceedings before a consumer arbitration board.
§ 13 Jurisdiction
For consumers, the statutory place of jurisdiction is their place of residence.
§ 14 Contract Language
The contract is available in German and English.
In case of discrepancies, the German version shall prevail.
§ 15 Final Provisions
Should any provision of these Terms and Conditions be invalid, the remaining provisions shall remain unaffected.
